  • Client: A company or organization that subscribes to MOM Digital’s Service.
  • Subscription Plan: The specific payment plan and service level the Client has selected.
  • Data: All information, including personal and business data, entered or processed within the MOM Digital system by Users.

3. License and Access

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes, subject to these Terms. You may not modify, reverse-engineer, or copy any part of the Service unless expressly permitted.

4. Subscription and Fees

  • Subscription Plans: Access to the Service is provided on a subscription basis. The details of your subscription, including the term, fees, and features, are defined during registration.
  • Billing and Payment: All fees are charged according to the chosen subscription plan. You agree to provide accurate payment details and ensure payment is made in accordance with the terms

5. Data Privacy and Security

  • Data Ownership: The Client retains ownership of all data uploaded, entered, or generated using the Service. However, you grant MOM Digital a license to process and store this data for the purposes of providing the Service.
  • Data Protection: MOM Digital is committed to maintaining the confidentiality and security of your data. We adhere to data protection laws applicable in the UAE and other relevant jurisdictions.
  • User Responsibility: You are responsible for maintaining the confidentiality of login credentials and ensuring authorized use of your account.

6. Service Availability

MOM Digital strives to provide continuous access to the Service. However, we do not guarantee 100% uptime and may experience scheduled or unscheduled maintenance. We are not liable for interruptions, delays, or errors in service provision beyond our control.

7. Intellectual Property

All content, software, designs, and trademarks within MOM Digital are the exclusive intellectual property of the Company or its licensors. You agree not to reproduce, distribute, or create derivative works based on our intellectual property.

8. User Conduct

Users must not:
  • Misuse the Service for unlawful activities.
  • Interfere with the operation or performance of the Service.
  • Upload or transmit harmful content, including malware or viruses.

9. Confidentiality

You agree to maintain the confidentiality of all non-public information obtained through MOM Digital, including but not limited to business processes, pricing, and technical data.

10. Termination

We reserve the right to terminate your access to the Service for violating these Terms or engaging in fraudulent or illegal activities. Upon termination, your access to the Service will cease, but we will retain and protect your data in accordance with our privacy policy.

11. Limitation of Liability

To the extent permitted by law, MOM Digital shall not be held liable for any indirect, consequential, or punitive damages, including loss of revenue, profits, or data, resulting from your use of the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless MOM Digital and its employees, directors, and agents from any claims or damages arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
